Terms of Service
By using or paying for 404’s desktop privacy application (“404” or “Service”), you agree to these terms. These Terms apply to all visitors, users, free trial users, and others who access or use the Service.
If you do not agree to the terms and conditions of this Agreement, in whole or in part, please do not use the Service.
Description of Service
404 is a desktop application that routes your network traffic through a local proxy to replace your device's network fingerprint with a consistent, believable alternative identity. This includes your TLS handshake characteristics, HTTP headers, browser API surfaces, and TCP/IP packet values.
404 replaces the aforementioned technical characteristics your device broadcasts when connecting to websites. These characteristics, taken together, form a fingerprint that can identify you across sessions, networks, and browsers even when cookies are cleared and a VPN is active. 404 substitutes that fingerprint with a coherent alternative.
404 runs entirely on your machine. No traffic is routed through our servers. We do not have the ability to log, inspect, or retain your browsing activity.
Access to the compiled application requires an active subscription. The underlying proxy component, STATIC, is open source software licensed under the GNU Affero General Public License v3.

Privacy
404 is local-only software. We do not have the ability to observe, log, or retain your browsing activity or network traffic.
We collect and store only what is necessary to operate your account: your email address, subscription status, and authentication timestamps. Payment is processed by Stripe — we do not store payment card information. You can read Stripe's privacy policy at https://stripe.com/privacy.

Subscriptions
Access to 404 is billed on a subscription basis. Subscriptions are available on a monthly or annual billing cycle and renew automatically at the end of each period unless cancelled. You may cancel your subscription at any time through your account management page. Cancellation takes effect at the end of the current billing period, after which access to the compiled application will be suspended.
Payment is processed through Stripe. By subscribing you authorize us to charge your payment method on a recurring basis for the applicable subscription fee. You are responsible for providing accurate billing information and keeping your payment method current. You are also responsible for any taxes, transaction fees, or currency conversion charges applied by your financial institution. All amounts are in US Dollars.
Access to 404 is tied to the email address used at signup. Your account is personal and non-transferable. You may not share your subscription with others.
Fee Changes
404 reserves the right to modify subscription pricing at any time. Any price change will take effect at the start of your next billing cycle. We will provide reasonable notice of any pricing changes via email or a prominent notice on 404privacy.com. Your continued use of the service after a fee change constitutes acceptance of the new pricing. If you do not agree to the new pricing you may cancel your subscription before the change takes effect.
Refund Policy
404 offers a 10-day free trial before any payment is required.
Because you can fully evaluate the software before subscribing, all payments are final and non-refundable. If you have questions or concerns about your subscription contact [email protected].
Accounts
An account is created when you subscribe using a valid email address. Your email address serves as your account identifier and is used to deliver authentication links. We do not store passwords.
Access to the Service is granted through a magic link sent to your email address. You are responsible for maintaining access to that email address. If you lose access to the email address associated with your account, we may not be able to recover it.
Your account and subscription are personal and non-transferable. You may not share access to your account with others.

Acceptable Use
404 is designed to protect your privacy and digital identity. It is not designed or intended for use in automated scraping, fraud, or multi-account abuse. Use for those purposes is prohibited.
You may use 404 for lawful purposes only. By using the Service, you agree not to use 404 to:
- Violate any applicable law or regulation
- Circumvent legal obligations or court orders
- Harass, stalk, or harm any individual
- Transmit malware, spyware, or other malicious code
- Interfere with or disrupt any network, system, or service
We reserve the right to terminate accounts that we reasonably believe are in violation of this policy.
Termination
You may cancel your subscription at any time through your account management page. Cancellation takes effect at the end of the current billing period.
404 reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to other users or the integrity of the Service. In cases of termination for cause, no refund will be issued for any remaining subscription period.
Upon termination, your right to access the compiled application ceases. Sections of these Terms that by their nature should survive termination — including disclaimer of warranties, limitation of liability, and governing law — will survive.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 404 EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
404 DOES NOT WARRANT THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERROR, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. NO ORAL OR WRITTEN INFORMATION PROVIDED BY 404 OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
404 is a privacy tool designed to reduce fingerprint-based tracking. It does not guarantee anonymity, and it does not protect against all forms of surveillance, tracking, or identification. You are solely responsible for evaluating whether 404 meets your security and privacy requirements before relying on it.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 404 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PRIVACY, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF 404 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL 404'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO 404 IN THE TWELVE MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL. IN SUCH JURISDICTIONS, 404'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in El Paso County, Colorado.
Dispute Resolution
Before initiating any formal legal proceeding, you agree to contact 404 at [email protected] and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the issue within 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in court for claims involving intellectual property or unauthorized access to the Service.
You agree to resolve disputes with 404 on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Changes to These Terms
404 reserves the right to modify these Terms at any time. Any material changes will be announced via email or a prominent notice on 404privacy.com at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms you may cancel your subscription before the changes take effect.
